To reduce Drugged Driving fatalities and injuries, people who are found to have driven under the influence of drugs must be monitored to prevent continued drug use as a condition of their being able to drive. Licenses should be revoked for all offenders until it can be determined that the drivers are drug-free and pose no further threat to others’ safety as a result of illegal drug use.

Drugged Driving offenders should be assessed for drug abuse and dependence, with those in need of treatment or rehabilitation offered access to the appropriate programs. Even those who may not need treatment do require random drug tests to insure that they remain drug free for a substantial period of time after conviction for Drugged Driving.

Driving Under the Influence of Drugs Court

All drivers convicted of Drugged Driving should be made go through DUI Drug courts. DUI Drug Courts are modeled on the DUI courts; they are specialty courts for those convicted of Drugged Driving. These court programs have proven remarkably effective at reducing the rate of recidivism among offenders. While the number of DUI drug courts is growing, there are still too few.

When drivers are found guilty of Drugged Driving, they, as part of their commitment to go through DUI Drug Court, should be drug tested on a random basis until they are no longer using any illegal drugs. If the drivers continue to test positive for drug use, they should be made to seek professional drug and addiction counseling. No one who is dependent on drugs should be allowed to drive, and only continued random drug testing will ensure that this is the case.

Treatment Options

There are a variety of treatment options that vary according to the level of need of the individual and the severity of his addiction. For most drugged driving offenders, one encounter with the law will be enough for them to stop using drugs; for others complete rehabilitation may be necessary to ensure they free themselves of addiction.

Only a trained professional may be able to accurately assess the level of dependency and be able to offer appropriate help. All drugged driving offenders must therefore be assessed by a professional as a part of their overall court ordered license reinstatement program.
